Welcome to davidgood.org. These Terms and Conditions ("Terms") govern your use of the website davidgood.org (the "Site"), operated by Organization For Good LLC, a Michigan limited liability company ("Organization For Good," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms apply to the Site only. Separate agreements govern our leadership mentoring program, speaking engagements, and any other paid services. If you are a client of one of those services, the terms of that separate agreement control over these Terms with respect to that relationship.
1. Eligibility
The Site is intended for adults aged 18 or older. By using the Site, you confirm that you are at least 18 years old. We do not knowingly allow anyone under 18 to use the Site. If you are under 18, please do not submit any information through the Site.
2. Use of the Site
You may use the Site to read, view, listen to, and download content we make publicly available, and to contact us through the contact form. You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others, restrict their use of the Site, or interfere with the Site's operation.
You agree not to:
- Use the Site in any way that violates any applicable law or regulation
- Submit false, misleading, or harassing information through the contact form
- Attempt to gain unauthorized access to any part of the Site, related systems, or accounts
- Use any automated means (bots, scrapers, harvesters) to access or collect data from the Site without our written permission
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site for commercial purposes without our written permission
- Upload or transmit viruses, malware, or any other harmful code
- Use the Site to impersonate any person or entity
We reserve the right to refuse service, restrict access, or take any legal or technical action we consider appropriate if you violate these Terms.
3. Contact Form
The Site includes a contact form where you can submit your name, email, phone number, a reason for contacting, and a message. We use this information to respond to your inquiry as described in our Privacy Policy. Please do not submit confidential, sensitive, or privileged information through the contact form. We make no promise that your message will reach us, that we will respond, or that we will respond within any particular timeframe.
4. Intellectual Property
All content on the Site, including text, images, graphics, logos, video, audio, downloads, frameworks, branding, and the overall look and feel, is the property of Organization For Good LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may view and share the Site's publicly available content for personal, non-commercial purposes, with attribution where reasonable. You may not reproduce, modify, distribute, sell, license, or create derivative works from any content on the Site without our prior written permission, except as expressly allowed in these Terms or by applicable law.
The names "Organization For Good," "International Friend Connection," "The Friend Magnet," "Friend Magnet Self-Leadership Framework," and any related logos and slogans are trademarks of Organization For Good LLC or its affiliates. You may not use them without our written permission.
If you believe content on the Site infringes your copyright, please contact us through the contact form with: a description of the copyrighted work, the location on the Site of the alleged infringement, your contact information, a statement that you have a good-faith belief that the use is not authorized, and a statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the copyright owner.
5. Your Submissions
If you submit comments, suggestions, ideas, or other content to us through the contact form or otherwise (collectively, "Submissions"), you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, publish, and distribute that Submission in any form. You represent that you own or have the right to share each Submission and that the Submission does not violate any third party's rights.
We have no obligation to keep Submissions confidential, to compensate you for them, or to respond to them.
6. Third-Party Links and Services
The Site links to third-party websites and services, including Amazon (for books), Heartbeat (for our community), YouTube, Meetup, Google, and Meta. We do not control these third parties, and we are not responsible for their content, products, services, privacy practices, or terms. Linking to a third party does not mean we endorse it. Your use of any third-party website or service is at your own risk and governed by that third party's terms and policies.
7. No Professional Advice
The content on the Site is provided for general informational and educational purposes only. It is not legal, medical, psychological, financial, business, or therapeutic advice. Reading or using the Site does not create a professional relationship of any kind between you and Organization For Good LLC, David Good, or any of our affiliates.
The leadership mentoring program is provided under a separate written agreement that defines that relationship. Nothing on the Site creates a mentoring, coaching, therapeutic, advisory, or fiduciary relationship.
Always consult a qualified professional before acting on information you find on the Site. We make no representation or warranty that the content on the Site is appropriate for your situation.
8. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND QUIET ENJOYMENT.
We do not warrant that the Site will be uninterrupted, secure, free of errors, free of viruses or other harmful components, or that defects will be corrected. We do not warrant that any content on the Site is current, complete, or accurate. Your use of the Site is at your own risk.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ORGANIZATION FOR GOOD LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE, INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the limitation or exclusion of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits our liability for fraud, gross negligence, willful misconduct, or any liability that cannot be limited or excluded under applicable law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Organization For Good LLC and its members, officers, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: your use of the Site; your violation of these Terms; your violation of any law; or your violation of any right of any third party.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding arising from or related to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Kent County, Michigan, and you consent to the personal jurisdiction of those courts.
If you live in a state or country whose laws give you the right to bring claims in your home jurisdiction notwithstanding the above, this paragraph does not override that right.
12. Class Action Waiver
To the fullest extent permitted by law, you and Organization For Good LLC agree that any dispute will be brought in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative action. You waive any right to participate in a class action against us.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top. Significant changes will be noted on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms. If you do not agree to the updated Terms, please stop using the Site.
14. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. The provisions of these Terms that by their nature should survive termination (including Sections 4, 5, 7, 8, 9, 10, 11, 12, and this Section 14) will survive.
15. Severability
If any provision of these Terms is found to be unenforceable, the rest of the Terms will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
16. No Waiver
Our failure to enforce any provision of these Terms is not a waiver of that provision or any other. Any waiver must be in writing and signed by us.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Organization For Good LLC regarding your use of the Site, and supersede any prior agreements between you and us regarding the Site. Separate written agreements (for example, for the leadership mentoring program) govern those specific relationships.
